This Privacy Policy describes how Does the Dog Die, LLC, a Texas limited liability company (“we,” “us,” “our”), collects, processes, retains, and discloses personal data about you when providing services to you through our websites, products, and services that link or refer to this policy (our “Services”) and our practices for using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect:

  • Through the Services; and
  • In communications, including email, text, chat, and other electronic messages, between you and the Services.

It does not apply to information collected by:

  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services.

We may provide additional or different privacy policies that are specific to certain features, services, or activities.

By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Privacy Policy. This policy may change from time to time. Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. Personal Data We Collect or Process.

“Personal Data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information (for example, account information such as name, postal address, and email address, or any other identifier we may use to contact you online or offline).

The types and categories of Personal Data we collect or process include:

  • Account and contact information, including name, email address, username, and other contact information you provide us.
  • Account history, including information about your subscription, account, transactions, purchases, order history, or discounts.
  • Payment information. Payments made on our website are collected and processed by Stripe, Inc. Purchases made inside our mobile apps are collected and processed by the Apple App Store or Google Play, with subscription status managed on our behalf by RevenueCat, Inc. We do not collect, receive, or store your payment card number, expiration date, or security code, in whole or in part. What we store is a Stripe customer identifier and the status, plan, and renewal date of your subscription, which is what we use to keep your access in sync with your payments. Your card details are handled by Stripe under Stripe’s privacy policy.
  • Content and information you elect to provide through the Services or emails, chats, or other communications sent to us. The content you elect to provide through the Services is governed by our Terms of Use, expressly incorporated herein by reference.
  • Usage and device information, including your IP address, browser type, device type, operating system, referring pages, pages viewed, and interactions with the Service, collected through cookies and similar technologies. Usage and device information is collected and processed by Google Analytics and by our advertising providers.
  • Approximate location. We do not collect GPS or other precise geolocation data from your device. Our analytics and advertising providers may infer an approximate location, such as country or region, from your IP address, and we use that only to apply the correct privacy regime to your visit, to serve region-appropriate advertising, and to understand where our audience is.

Some of the Personal Data identified above, including payment information and usage and device information, is collected and processed by third-party service providers, including Stripe, Inc. and Google Analytics, to facilitate our Services and conduct business operations on our behalf. Purchases made inside our mobile apps are not processed by Stripe: they are processed by the Apple App Store or Google Play, and your subscription status is managed on our behalf by RevenueCat, Inc., which also receives the account identifier we use to keep your purchases in sync with your account. To the extent any Personal Data is collected directly by these third parties, such collection and processing are governed strictly by their respective privacy policies. We expressly disclaim all liability for the independent acts, omissions, or data breaches of third-party service providers to the maximum extent permitted by applicable law.

We also collect:

  • Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate Personal Data to calculate the percentage of users accessing a specific Services feature.
  • Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
  • Aggregated content data. We license aggregated content-warning data—such as ratings, comments, and timestamps associated with media titles—to third parties on a commercial basis. This licensed data concerns media titles, not individual users: it does not include your username, email address, or any other identifier, and is provided in a form that does not identify you personally.

If we combine or connect non-personal statistical or technical data with Personal Data so that it directly identifies an individual, we treat the combined information as personal information.

2. Children’s and Minors’ Data.

Our Services are not intended for, and we do not knowingly collect any personal data from children under the age of 13. If we learn that we have collected or received personal data from a child under 13 years old without verified parental consent, we will delete that information promptly. We also do not knowingly collect, sell, or share any Personal Data from children under the age of 16 without affirmative authorization or verification of parental consent. 3. How We Collect Your Personal and Other Data.

3.01 When You Provide Information to Us.

We collect information about you when you interact with our Services, such as when you create or update an account, subscribe, or make a purchase, or create, upload, or post content to the Services.

3.02 Automatically Through Our Services.

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include Personal Data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, logs, and which resources and Services features that you access and use.

We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking).

Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.

  • Payment processors, such as Stripe, Inc.

5. Large Language Model Training Disclosure.

We do not send or use your personal data to train large language models.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

7.01 Advertising, marketing, cookies, and other tracking technologies choices.

In our mobile apps, where there is no browser to configure, you can limit tracking through your device’s own privacy settings — for example by resetting or limiting your advertising identifier, or by declining tracking permission when the app asks for it. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this policy.
  • Consent Banner. If you visit the Services from the European Economic Area or the United Kingdom, we present a consent banner, and advertising and analytics technologies are prevented from storing or accessing information on your device until you answer it. You can reopen the banner and change your choices at any time using the “Privacy Manager” link in the page footer.

8. Your State Privacy Rights.

Depending on your state of residency, you may have certain rights related to your Personal Data, including:

  • Access and Data Portability. You may confirm whether we process your Personal Data and access a copy of the Personal Data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.
  • Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.
  • Opt Out of Using Personal Data for Sales, Targeted Advertising, and Profiling for Certain Legal or Similarly Significant Decisions. You may request that we do not use your Personal Data for these purposes.

The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

9. How We Protect Your Personal Data.

9.01 Security.

We use commercially reasonable administrative, physical, and technical measures designed to protect your Personal Data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of Personal Data is at your own risk. The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.

9.02 Data Breach Notification.

While we strive to protect your Personal Data, no system is entirely secure. In the event of a security breach that materially compromises your Personal Information, we will promptly notify you and any applicable regulatory authorities as required by applicable state, federal, or international law, and in any event within the timeframes mandated by such laws.

10. How We Retain Your Personal Data.

We keep the categories of Personal Data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, Personal Data will be deleted, destroyed, or deidentified.

User contributions may be retained and used indefinitely, including after account deletion, though we will disassociate them from your personal identifiers.

11. Changes to Our Privacy Policy.

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the Privacy Policy was last reviewed and updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.

13. Supplemental Privacy Notice for California Residents.

This Supplemental Notice for California Residents applies solely to individuals residing in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

13.1 Information We Collect and Disclose.

In the preceding twelve (12) months, we have collected the following categories of personal information from consumers: Identifiers (e.g., name, email address, IP address), Commercial Information (e.g., purchasing history), and Internet or other electronic network activity (e.g., browsing history), Geolocation Data, and Behavioral Data. We collect this information directly from you, from your devices, and from our third-party analytics providers.

13.2 Sale and Sharing of Personal Information.

Under the CCPA, “selling” or “sharing” includes disclosing personal information to a third party for cross-context behavioral advertising. In the preceding 12 months, we have sold or shared identifiers and internet activity with advertising networks. You have the right to opt out of this sale or sharing by emailing us at support@doesthedogdie.com, by submitting the privacy request form, or by utilizing a Global Privacy Control (GPC) signal.

13.3 Do-Not-Track.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

14. GDPR / UK GDPR Supplemental Notice.

14.1 Information for EEA and UK Users, Legal Basis for Processing.

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), we only process your Personal Data where we have a valid legal basis. This includes processing necessary to perform our contract with you, processing based on your explicit consent, or processing necessary for our legitimate business interests (such as improving our Services or maintaining security).

14.2 Cross-Border Data Transfers.

We are located in the United States. If you access our Services from the EEA or the UK, your data will be transferred to the US. We rely on legally provided mechanisms to lawfully transfer data across borders.

14.3 Right to Lodge a Complaint.

EEA and UK residents have the right to lodge a complaint regarding our data practices with a local supervisory authority in their country of residence.
